The petitioner has filed an application under Section 41-A of the Maharashtra Public Trusts Act, 1950 before the learned Assistant Charity Commissioner, Chandrapur. It is, however, stated by the learned Counsel for the petitioner that the learned Assistant Charity Commissioner is on leave for a period of six months from 03/04/2023. Since the present proceedings could not be entertained, the petitioner has moved this Court.

02] It is open for the petitioner to move the Competent Officer empowered to exercise jurisdiction under Section 41-A of the Act to whom such charge has been given in absence of the learned Assistant Charity Commissioner, Chandrapur.

03] The petitioner is also free to make a request to the learned Joint Charity Commissioner, Nagpur to consider whether the said proceedings could be considered at Nagpur in accordance with law. Keeping all points open, the writ petition is disposed of with aforesaid liberty. There shall be no order as to costs.
