Apprehending the arrest at the hands of police in connection with Crime No.55/2024 registered with Police Station Jaripatka, District Nagpur for the offences punishable under Sections 406, 409 and 420 read with Section 34 of the Indian Penal Code, the applicant approached this Court for grant of pre-arrest bail.

As per the allegation one Harshal Shivrajsingh Waghmare is the Proprietor of Pavitra Solar Engineering and he had been to the dog Training Center in October 2022. He communicated with the informant that he would sent him the relevant documents for the purpose of training and during communication, it revealed that he also asked him to install the solar panel and asked him to pay some amount towards the expenses of installation of

(2) 31.aba.266.2024 the solar panel. It is alleged that though he paid the amount, but the applicant has not fulfilled the promise and the informant was duped for the amount of Rs.1,35,000/-.

On perusal of the investigation papers, it revealed that the entire transaction is of a civil nature. As far as the allegation is only that the solar panel was not installed and money is accepted. 4.

Considering the nature of the allegation, the custodial interrogation is not required, in view of that, the interim protection granted to the present applicant deserves to be confirmed with modification that the applicant shall attend the concerned Police Station as and when required for the investigation purpose and shall co-operate with the investigating agency.
