After advancing the arguments for some time, learned Advocate for the petitioners, upon instructions, seeks permission to withdraw the instant petition with liberty to file an appropriate application under Section 34 of the Arbitration and Conciliation Act, 1996.

The petitioner is permitted to withdraw the petition. 3.

In view of this, the Writ Petition is disposed of as withdrawn with liberty as prayed for.

It is clarified that all the issues on merits are kept open. 5.

In case an application under Section 34 of the Act of 1996 is filed, the petitioner is entitled to point out the fact of pendency of instant petition in support of his application for condonation of delay, if any.
