Both these applications are moved by the respective parties to the petition seeking modification of the order dated 10.01.2024. 2.

It is claimed that the promotional avenue to the post of Executive Engineer to the parties to the petition and other similarly placed persons is already opened and under process with the State Government.

In such an eventuality, it is claimed that the Court may modify the order dated 10.01.2024 to the extent that the respondent-State be permitted to go ahead with the promotional process, subject to final outcome of the writ petition.

Since the aforesaid prayer is moved by all the private parties to the petition and the same is not objected to by the State, we deem it appropriate to dispose of both the civil applications, by partly allowing the same.

Accordingly, we hereby permit the respondent-State Government to go ahead with the promotional process for the post of Executive Engineer, which shall be subject to the final outcome of the writ petition.

The civil applications stand disposed of in aforesaid terms.
