DATE : December 07, 2015 The challenge in both these writ petitions is to an interlocutory order passed on the application for grant of stay.
The learned Assistant Charity Commissioner, Bhandara has decided the Scheme Application No.03/2014 by order dated 21/10/2014. This order was challenged by filing appeal before the learned Ad-hoc District Judge-I Bhandara. By order dated 15/04/2015, stay was granted by the Appellate Court pending decision of the proceedings. Being aggrieved, the present writ petitions have been filed.
On 07/05/2015, this Court while issuing notice
21-WP-2714-2715-15 2/2 had passed the following order :
" In the meantime, the parties are directed to maintain status quo. However, the body functioning shall not take any major decision."
It is informed that the proceedings before the Appellate Court are still pending. Hence without going into merits of the matter and by expediting the proceedings before the Appellate Court, the parties shall continue to maintain status quo as directed on 07/05/2015 with further directions that the body functioning shall not take any major decisions during pendency of the proceedings. This order is without prejudice to the right of the parties. The proceedings in M.J.C. Nos.66 of 2014 and 68 of 2014 are expedited and same shall be decided by end of April 2016.
Rule is made absolute in aforesaid terms with no order as to costs.
