ATE : SEPTEMBER 6 , 2023 By this Civil Application, the original petitioner seeks issuance of various directions as referred to in the prayer Clauses. This Civil Application has been filed in Public Interest Litigation No. 31/2021 which came to be disposed of by observing in paragraph 4 as under :
"4. However, since the Executive Engineer has already taken cognizance of the issue, we expect that the Executive Engineer will take steps, as mentioned in his communication, within a reasonable time after following the due procedure." In the reply filed by the Executive Engineer, the steps taken with regard to the unauthorized encroachment and contamination of water have been referred to and various communications have been addressed to the concerned Authorities.
2] We find that since the Public Interest Litigation was disposed of merely by requiring the Executive Engineer, Maharashtra State Electricity Transmission Company Limited to take steps, it would be necessary for the petitioner to initiate appropriate proceedings if he is not satisfied with the steps taken in accordance with the order dated 9/3/2022.
