On 27.8.2019, this Court was required to pass order directing presence of Superintendent of Police at Buldhana in this Court since learned Additional Public Prosecutor Shri J.Y.Ghurde for the State submitted before this Court that in spite of repeated calls given to Investigating Officer he is not responding.

In pursuance to order dated 27.8.2019, Buldhana Superintendent of Police Dr.Dilip Patil-Bhujbal, is personally present. He informed facts which gave rise to situation. He has filed his personal affidavit also. I have gone through the said affidavit and I am satisfied about actions taken by the said Officer.

It is expected in future that there will be immediate response to calls given by Office of the Public Prosecutor so that Public Prosecutors will be able to point .....2/-

Heard learned counsel Shri Z.Z.Haq for applicants and learned Additional Public Prosecutor Shri J.Y.Ghurde for the State. Also, perused reply filed on behalf of the State and investigating papers.

When the Court was about to dismiss the present application for grant of anticipatory bail, learned counsel Shri Z.Z.Haq for applicants submitted that he has instructions to withdraw the present application. 6.
The criminal application is dismissed as withdrawn.
7.
Needless to mention that interim order dated 10.4.2019 granted by this Court (Coram : M.G.Giratkar, J. stands vacated.
8.
It is expected from Investigating Officer to take necessary steps in accordance with law.
