: 30 APRIL, 2015 Only request is to direct respondents to first complete process of promotion and then to start absorption of surplus teachers. Advocate Shri Kshirsagar submits that posts becoming vacant after the incumbent is promoted, can then be distributed amongst surplus teachers. Learned A.G.P. pointed out that there is no challenge to the act of declaring petitioners as surplus. Petitioners cannot force their employer to fill in promotional posts. As such, we do not find any legal rights being violated. However, if the petitioners report at absorbed place and make such grievance thereafter, we grant them leave to approach again if their representation is not looked into within reasonable time. With this liberty, writ petition is disposed of. No costs.
