2] The petition challenges the order dated 22.02.2019 passed by the learned SDO/Respondent No.1 granting permission for commercial utilization of 1500 sq.ft. of land out of the total 10,000 sq.ft granted to Mahatma Jyotiba Fuley Sarvajanik Vachanalaya, Ralegaon, for running a library, on the ground that funds need to be generated for the purpose of running the library.
3] A plea is being raised by Mr. Thakkar, learned counsel for the petitioner that there is an additional construction than what has been permitted and so also regarding the nature of businesses permitted to be run in the construction which is completed.
(2) 12wp4810.21 4] Perusal of the impugned order indicates that these pleas are not raised while challenging the impugned order which relates only to the commercial utilization of part of the land for the purpose of making the library self sustaining. Any grievance the petitioner may have regarding the nature of construction or the nature of business permitted there, since the construction is already completed, can be raised before the appropriate authority. I therefore do not see any reason to interfere in the impugned order which only intends to make the working of the library self sufficient. The petiotn is therefore, dismissed, no costs.
