Heard learned counsel for the parties.

Perused the statements of the eye witnesses.

It appears that applicant no.2-Mangesh Arjunrao Avsarmol has been the member of the unlawful assembly which actually assaulted deceased. Insofar as the applicant no.1-Amol Ashok Wadekar is concerned, there is no specific mention about him. In view of above, I make the following order.

ORDER

(i) Criminal Application No.307/2015 is partly allowed.

(ii) The applicant no.1-Amol Ashok Wadekar shall be released on bail in Crime No. 328/2014 for an offence punishable under Sections 147, 148, 149, 302 of the Indian Penal Code registered with Police

ba307.15 Station, Frezarpura, Dist. Amravati on his executing PR Bond in the sum of Rs.20,000/- with one surety in the like amount.

(iii) Applicant No.1-Amol Ashok Wadekar shall not tamper with the prosecution evidence and shall not influence the witnesses.

(iv) Applicant No.1-Amol Ashok Wadekar shall attend Police Station, Frezarpura, Amravati on last Sunday of every month from 11.00 a.m. to 04.00 p.m. and shall cooperate with the investigating officer.

(v) The present application, so far as applicant no.2-Mangesh Arjunrao Avsarmol is concerned, it is rejected.
