The applicant seeks pre-arrest bail, apprehending arrest in connection with crime registered against him and 7 others for offence punishable under Sections 420, 406, 409, 120-B read with Section 34 of the Indian Penal Code.

Accusations against the applicant are that he has lured investors to invest huge amount in the scheme floated by the company where he had been working. The application is opposed on the ground that the custodial interrogation of the applicant is required to unearth the truth and to collect evidence against all the accused involved in the scam in which investors are duped of more than Rs.24,000,00/-.

According to the applicant, he was in the

2 aba259.17 employment of the company and to substantiate this, photocopies of passbook showing deposit of salary in account every month are placed on record.

This Court has granted interim protection to the applicant by order passed on 17th April, 2017 imposing conditions that the applicant would attend police station and co-operate with the investigating agency. The applicant has complied with the directions given by this Court.

Considering the facts of the case, the order passed by this Court on 17th April, 2017 granting protection to the applicant is confirmed.

The applicant shall deposit his passport with the Investigating Officer within one week.

If passport is not issued in the name of applicant then he shall file an affidavit to that effect before the Investigating Officer within one week. The application is allowed in the above terms. JUDGE Tambaskar.
