Learned Advocate Ms. Radhika Raskar for the appellant submitted that the sole appellant is reported to be dead and after sufficient efforts, she has no instructions from the legal representatives of the deceased appellant to appear in the matter on his behalf. In fact, the legal heirs are not brought on record. By order dated 29.03.2023 last chance was granted to the appellant. But, today also, learned Advocate for the appellant submitted that as she has no instructions, she is unable to take any steps to bring the legal heirs on record. In view of that, learned Advocate Ms. Radhika Raskar is discharged.

As after sufficient time, no steps are taken to bring the legal heirs of the appellant on record. The

(2) 4.fa.10.2010 appeal is to be disposed of as abated. In view of that, appeal is disposed of.

Learned Advocate Mr. A. M. Quazi present for respondent No.3.

Respondent No.1 is permitted to withdraw the amount of compensation along with accrued interest, on due identification and verification.

The respondent No.1 is at liberty to withdraw the amount of compensation if deposited along with accrued interest.
