Heard Advocate Mr.Ateeb Syed for petitioner and learned Additional Public Prosecutor for the State.
Learned APP invites attention to prayer clauses to urge that disciplinary action is sought against erring police Officers on administrative side.
According to the learned counsel for the petitioner, suitable cognizance of complaint made by complainant/victim has not been taken by police authorities and they have shielded respondent no.8. He, therefore, submits that appropriate cognizance of complaint made by petitioner against respondent no.8 needs to be taken and for lapse or dereliction of duty on the part of police officers, action against them also needs to be taken.
In this background we have examined the papers. A Writ of Mandamus is being sought in the matter. Petitioner himself has not made any representation. The representation dated 8th of April, 2015 at Annexure 'B' is by an Association which espouses his cause. Learned counsel for the petitioner also sought liberty to move appropriate amendment application.
In this situation, we find that the interest of justice can be
2 0906cwp375.15.odt made by giving petitioner liberty to move appropriate representation to respondent no.3.
If said representation seeking necessary action is moved within period of four weeks from today, respondent no.3 or concerned respondent shall look into it in accordance with law within next six weeks.
Keeping all rival contentions open and with these directions, we dispose of present Criminal Writ Petition. No costs.
