None had appeared on behalf of the appellant on 10.6.2015. None had appeared for the respondent also. Hence, we had dismissed the appeal for want of prosecution. For the reasons stated in the application, we condone the delay in filing the restoration application.

The Civil Application is allowed and disposed of. MCA ST. NO.8874/2016 Heard. Perused the contents of the application. For the reasons stated in the application, the Family Court Appeal is restored to file, subject to payment of costs of Rs.750/- to the Vidarbha Lady Lawyers Association, within one week. If the costs are paid and the Family Court Appeal is restored to file, issue notice to the respondent for hearing of the Family Court Appeal on merits.
