There is a delay of 32 days in filing the second appeal. It is stated that after the appeal was decided by the learned First Appellate Court, the applicant had approached the learned Advocate representing him in the second appeal for filing the second appeal. However, he was not having all the relevant documents with him. It is further stated that the documents were collected from the learned Advocate appearing before the First Appellate Court and provided to the Advocate appearing in the Second Appeal in the month of January, 2023. As a consequence of which delay of 32 days has occurred in filing the second appeal.

Although the learned Advocate for the respondent strongly opposes the application, having regard to the reasons mentioned in the application, in the considered opinion of this Court, the application
