The learned A.P.P. for the State has submitted that the applicant is the permanent resident of Chandrapur and he is absconding from the last 12 years.

The applicant came to be arrested in respect of crime which occurred in 2004.

Undoubtedly, the applicant was not traced out in all these years and now somehow he has been arrested and put in jail.

Upon perusal of the reply it reveals that the charge has already been framed.

The learned Counsel for the applicant submits that the charge has not been framed and the trial Court has

not fixed the programme, because some of the accused persons are still absconding. I think, the trial Court should think whether to separate the trial of the present applicant/accused.

But the prayer for grant of bail of the applicant cannot be accepted, in view of the fact that the accused has been arrested after several years in the crime committed in the year 2004. As a sequel, I pass the following order :- Order A] Criminal Application (BA) No.311 of 2015 is rejected.

B] The Sessions Judge is directed to take appropriate steps accordingly.
