Apprehending the arrest at the hands of Police in connection with Crime No.75/2024 registered with Police Station M.I.D.C. Akola, Tahsil and District Akola for the offences punishable under Sections 354-C, 354-D, 354 and 506 read with Section 34 of the Indian Penal Code, 1860, the applicant approached this Court for grant of pre-arrest bail.

Learned counsel for the applicant submitted that as far as the present applicant is concerned against whom there is no allegation regarding outraging of modesty or stalking. That allegation is made against the co-accused. He submitted that considering the major role is attributed to the co-accused and as far as the present applicant is concerned, who was along with the

(2) 27.aba.278.2024 co-accused, his custodial interrogation is not required, in view of that the interim protection granted to him deserves to be confirmed.

Learned APP though strongly opposed the said application, but admitted the fact that the only role attributed to the present applicant that he was present along with the co-accused.

After hearing the both sides. On perusal of the recitals of the FIR and investigation papers. Except the association of the present applicant with the other co-accused against whom the allegation of outraging the modesty are made, no other role is attributed to the present applicant. In view of that the interim protection granted to the present applicant deserves to be confirmed on the similar conditions which are imposed by this Court by order dated 22.04.2024.
