It is apparent from reading of the interim order dated 04/03/2022 that while dealing with application for condonation of delay, the learned Divisional Commissioner has not dealt with the merits of the said application and has rather dealt with the merits of the revision application. The learned Divisional Commissioner has rejected the application for condonation of delay on the ground that the appeal preferred before the Collector was hopelessly barred by limitation. The learned Divisional Commissioner has clearly exceeded his jurisdiction while dealing with an application for condonation of delay. The order dated 04/03/2022 passed in Appeal No.392/LND-26/2017 of Mouza Aheri, Tahil Aheri, District Gadchiroli is, therefore, quashed and set aside with direction to the learned Divisional Commissioner to decide the application for condonation of delay afresh.

The parties to appear before the learned Divisional Commissioner on 8th December, 2025. The parties to note that separate notice for appearance will not be issued.
