The petitioner is an accused in criminal prosecution namely RCC No.109/2021. Learned counsel for petitioner would submit that he along with his wife are the only accused. It is submitted that since the last seven months the trial Court has not framed the charge and thus, directions are sought for expeditious trial.

It appears from the Roznama that there are 43 accused most of the time exemptions have been sought by accused wives on various dates, but the accused remained absent.

The trial has been pending from the last three years for framing of charge. Probably, due to the absence of the accused and charge has not been framed.

In view of above, the trial Court may take necessary steps to secure the presence of accused, it unwanted exemptions are sought. The petitioner along with his wife shall not claim exemption and co-operate with the trial Court for framing charge. The trial Court shall expeditiously decide the criminal prosecution.

The petition stands disposed of accordingly.
