Heard.

The only role attributed alleged against the applicant is that he had given a call from his motorcycle to Eknath to bring the truck on the person of Bhaskar Patil and accordingly Eknath had dashed the motorcycle of Bhaskar Patil and as such he fell down. Hence, an offence punishable under Section 307 of the IPC is lodged against the applicant. The applicant was arrested on 04.08.2014 and since then he is in jail.

In that view of the matter, I pass the following order.

ORDER

(i) Criminal Application No.312/2015 is allowed.

(ii) Applicant-Pramod Uttam Babhulkar, is directed to be released on bail on executing PR Bond in the sum of Rs.10,000/- (Rs. Ten Thousand Only) with one surety in the like amount.

ba312.15 (iii) The applicant shall not tamper with the prosecution witnesses.

(iv) During the pendency of trial, the applicant shall not enter the limits of Shegaon and shall reside at Akola and attend Police Station, Ramdaspeth, Akola on every Sunday from 11.00 a.m. to 04.00 p.m. JUDGE kahale
