DATE : 02/08/2023 Present application is filed by respondent Nos.1 and 2(i) to 2(iii) for grant of permission to withdraw the compensation amount of Rs.21,75,000/-, deposited by the appellant. After hearing both the parties and considering the reason, it would be appropriate to grant permission to withdraw 50% of total amount so deposited, subject to furnishing undertaking to the effect that if appellant succeeds in the matter, the respondent Nos.1 and 2(i) to 2(iii) shall redeposit the amount as per final order, which will be passed in the first appeal.

The Registrar, 2nd Joint Civil Judge Senior Division, Wardha, is hereby directed to disburse the amount after the aforesaid undertaking furnished by present respondents/claimants before Reference Court within two weeks.
