By this writ petition the petitioners seek a direction to be issued to the respondent no.1 to implement its coal distribution policy namely "Policy for distribution of coal to MSME consumers of Maharashtra" and further to direct the respondent no.2-The Maharashtra Mining Corporation Ltd as Nodal Agency to supply coal to the petitioners. After the notice was issued in the writ petition, it is informed by the learned Assistant Government Pleader for the respondent no.1 that on 24.01.2022 the Joint Secretary, Industries, Energy and Labour Department of the State Government has issued a communication to the General Manager, Coal India Limited, Kolkata stating therein that the State Government had decided to nominate the respondent no.2 as State Nodal Agency for distribution of coal to small, medium and other enterprises in the State for the years 2022-23 and 2023-24. The said communication is taken on record and marked 'A' for identification.

In view of aforesaid communication, the respondent no.2 has now been nominated as State Nodal Agency and hence it is directed to take necessary steps for distribution of coal to small, medium and other

913.WP2293.21.odt 2 enterprises in terms of the communication dated 24.01.2022. The Government Resolution dated 12.07.2016 along with the Policy for distribution of coal to MSME consumers of Maharashtra as well as the communication dated 20.08.2020 shall be taken into consideration by the respondent no.2 in that regard.
