At the outset, learned A.G.P. submits that the appeal under question, which is pending before respondent No.1 is listed for final hearing on 30th April, 2025.

The order dated 08/01/2025 passed by respondent No.2 thereby disqualifying the petitioner was stayed by respondent No.1 on 16/01/2025. The said order was extended till 27/03/2025. On 27/03/2025, the matter was taken up for hearing. Respondent No.5 appeared and moved application for intervention, which was allowed. Respondent No.1 has then vacated the stay on the ground that the documents filed by the intervenor would justify vacating stay. Respondent No.1 has not disclosed as to the nature of documents and its consequences. What is mentioned in the order is that, on the basis of documents filed by the intervenor, the order of status quo is vacated. Thus, the order is without any reason, much less valid and cogent reasons.

The order impugned is, accordingly, quashed and set aside. The order dated 16/01/2025 passed by respondent No.1 is restored.

The parties shall cooperate to dispose of appeal on 30/04/2025. No adjournments will be sought unless for extraordinary reason to the satisfaction of respondent No.1.

The appeal shall be decided by respondent No.1 on 30/04/2025 or immediately thereafter.
