By inviting attention to cognizance of offence taken against M/s. F.A. Constructions and demonstrating that because of documents found executed by other partners in favour of the managing partner, effort of learned Senior Counsel is to urge that as similar documentary exists in case of present applicants, cognizance needs to be taken only against the Managing partner/director.

Learned A.P.P. appearing for nonapplicants submits that investigating is still going on and if any such material surfaces during investigation, it will be duly considered.

We cannot observe either way at this stage upon the course to be followed by the investigating agency. However, it is apparent that the material surfacing as evidence cannot be overlooked by the authorities. With these observations and keeping all rival contentions open, we dispose of the present application. No costs.
