Review of order dated 08.02.2016 passed in Criminal Writ Petition No. 207 of 2015 is sought by the applicant.
Shri K.H. Deshpande, learned Senior Advocate with Shri V.U. Waghmare, learned counsel for the applicant/ petitioner submits that the reason that police custody remand was allowed by the learned Magistrate, recorded by this Court in its order dated 08.02.2016, is incorrect.
Shri N.R. Patil, learned AGP for the respondents has opposed the review.
We have perused the order dated 08.02.2016.
The relevant sentence appears as one of the contentions of the learned APP. We have not stated that PCR was granted, in our order. The perusal of order passed by the Magistrate on 20.11.2014 itself shows that while declining PCR, the learned Magistrate has granted judicial custody till
04.12.2014 i.e. roughly for a period of about 15 days. In this situation, we find no case made out warranting review. Review Application is, therefore, rejected. No costs.
