Heard the learned Counsel for the rival parties.
Perused the F.I.R. as well as the reply, from it it is clear that the applicant is the sister of main accused Hemant who was ill-treating the deceased on account of nonfulfillment of demand made by the accused person and used to tell the deceased that the deceased got married with her brother due to her help. In my opinion, prima facie, this by itself does not constitute the offence against the applicant. Hence, I make the following order :- Order A] Criminal Application (ABA) No.216 of 2015 is allowed.
B] Rule made absolute in terms of prayer clause (3) of the application.
C] The applicant is directed to cooperate with the Investigating Officer of Police Station Gittikhadan, Nagpur as and when required.
