Shri S.D. Borkute, learned counsel for the applicant, Shri N.D. Khamborkar, learned counsel for the non-applicant no.2 and Shri V.A. Thakare, learned A.P.P. for the State.

Shri Borkute, learned counsel for the applicant submits that the applicant is already protected by the anticipatory bail. The said statement is not disputed by learned A.P.P. for non applicant no.1-State as well as Shri Khamborkar, learned counsel for non applicant no.2.

Shri Borkute, learned counsel for the applicant would submit that he has instruction to withdraw the present application. He submits that liberty be granted to the applicant to file application for discharge before the Competent Court after filing of the charge-sheet by the prosecution.

The application is disposed of as withdrawn with a liberty to the applicant to file an application for discharge before the Competent Court after filing of the charge-sheet by prosecution.
