The applicant seeks pre-arrest bail, apprehending arrest in connection with crime registered against him and co-accused Ankush Verma for offence punishable under Section 65(a) of the Maharashtra Prohibition Act, Section 188 of the Indian Penal Code and Section 184 of the Motor Vehicles Act.
According to the investigating agency, both the accused were transporting liquor worth Rs.3,00,000/- for sale in Chandrapur district though sale of liquor in Chandrapur district is prohibited. According to the investigating agency, the vehicle from which liquor is seized, belongs to the applicant.
According to the applicant, the vehicle was taken by Ankush Verma and the applicant was not having knowledge that Ankush Verma was transporting liquor in his vehicle. The applicant has stated that he is not involved in any other crime / offence. This Court has
2 aba260.17 granted protection to the applicant by order passed on 26th April, 207 imposing conditions which are complied with by the applicant.
Considering the nature of accusations against the applicant and the facts of the case, the order passed by this Court on 26th April, 2017 granting protection is confirmed. The application is allowed accordingly. JUDGE Tambaskar.
