The prayer made in this petition is for issuing a direction to the learned 5th Joint Civil Judge, Senior Division, Akola, to conduct the trial of Special Civil Suit No.115 of 2018 in an expeditious way, considering the fact that the petitioner is 75 years' old. 3.

The learned counsel for the petitioner informs the Court that after filing of this petition, some progress has taken place in the conduct of the trial, and after allowing the amendment application, the additional issues have been framed. If such is the development, we can say that now the trial of the Suit has commenced. If that be so, we hope that the Suit would be finally decided and disposed of in accordance with law as expeditiously as possible, provided the rival parties do not seek any adjournment and do not create any obstacle by filing frivolous applications. Of course, we are also confident that if any such frivolous and unnecessary applications are filed and any unwarranted adjournments are sought by the parties, the Trial Court would deal with those applications and adjournments in accordance with law, without losing any further time in the matter.
