Heard Shri S.S. Doifode, Additional Public Prosecutor for the applicant/State of Maharashtra. The State of Maharashtra has approached this Court under Section 482 of the Criminal Procedure Code making grievance against the orders passed by the learned Special Judge on 10.4.2016 and 18.4.2016 rejecting the prayer of investigating agency to grant police custody remand of the non-applicant. It is submitted that after receipt of medical inspection report of the victim, it is found necessary that the nonapplicant/accused be sent for medical examination and, therefore, the police custody remand was sought. The medical inspection report of the victim is produced at the time of hearing.

Considering the facts of the case, I am not .....2/-

apl302.16 inclined to interfere with the discretion exercised by the learned Special Judge.

The applicant is at liberty to move appropriate application before the learned Special Judge requesting for permission regarding medical inspection of the non-applicant/accused.

With the above observations, the criminal application is disposed.
