The present application is for grant of bail under Section 439 of the Code of Criminal Procedure. 2.

After going through the investigation papers, it reveals that victim girl is 13 years of age and after hearing the learned Counsel for the applicant to some extent, I am not inclined to grant bail to the present applicant. The learned Counsel for the applicant seeks permission to withdraw the same with liberty to file before the trial Court, after recording the evidence of the victim.
