Learned Counsel for the respondent no.2 Shri C.A. Babrekar submitted that even prior to filing of the present application i.e. on 09-04-2019, the Investigating Officer has filed chargesheet on 14-03-2019. Even this fact is also mentioned by the learned APP in the reply filed on behalf of the State and the case is registered as Criminal Case No.6/2019.

In view of the matter, the learned Counsel for the applicants submits that he wishes to withdraw the present application with liberty to file application for discharge before the trial Court. 3.

Statement is accepted.

Application is disposed of as withdrawn with liberty to file application for discharge.

If the application is filed, the same shall be decided by the learned Judge in accordance with law.
