The applicant is arrested on 19th October, 2016 in crime registered against him for the offences punishable under Sections 302 and 498-A of the Indian Penal Code on the accusations that suspecting character of the deceased (wife of the applicant), the applicant has killed her by pouring kerosene and setting her ablaze.

The applicant claims to be a labourer and has stated that he is not involved in any other crime/ offence. The applicant and deceased have two children aged about 6 years and 5 years and according to the applicant the children are with father of the applicant. The mother of the applicant is reported to be dead.

The charge-sheet is filed on 31st January, 2017. The non-applicant has not been able to show that the custody of the applicant is required for further investigation.

2 ba374.17 Considering the above facts, following order is passed :

The applicant having been arrested in Crime No.233/2016, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Fifty Thousand and on furnishing two solvent sureties for Rs.Twenty Five Thousand each.

The applicant shall attend the sessions trial on every date unless granted exemption by the Sessions Court. The application is allowed in the above terms. CRI.APPLN.(APPP) NO.725/2017 In view of disposal of the bail application, the application praying for grant of time to file typed copy of handwritten pages does not survive, hence, it is disposed of.
