DATED : 11-08-2021 I was not inclined, at least at this stage, to exercise discretion in favour of the applicant who is accused of commission of offence punishable under Section 302 of the Indian Penal Code.

In this view of the matter, the learned counsel Mr. R. M. Daga seeks leave to withdraw the application, with liberty to apply afresh, if there is no significant progress in the trial in the next six months. 3.

The submission is reasonable. The applicant is relatively young and was aged 19 years as on the date of alleged incident. Even otherwise, the trial Court will have to accord priority to the trial since the applicant is in custody since 7-10-2020.

This application is disposed of as withdrawn with liberty as prayed for.

The trial Court is requested to expedite the trial. 6.
