DATE : 5.5.2016 Heard Shri R.M. Daruwala, advocate for the applicant and Shri S.B. Bissa, A.P.P. for the non-applicant no.1. The applicant has approached this Court under Section 439(2) of the Code of Criminal Procedure praying that the order passed by the learned Additional Sessions Judge on 19th December, 2015 granting pre-arrest bail to the non-applicants 2 and 3 be set aside and the pre-arrest bail be cancelled. The applicant has sought the cancellation of pre-arrest bail on the ground that the non-applicants 2 and 3 have threatened the applicant which amounts to breach of condition imposed by the Court while granting bail.

The applicant will have to move the Sessions Court, if so

With the above observations, the application is disposed. The fees of Shri R.M. Daruwala, advocate appointed to represent the applicant is quantified at Rs.2,000/- (Rs. Two Thousand Only).
