s petition, seeking restitution of conjugal rights was allowed.

In spite of service, today none appears for the non-applicant wife.

Reasons for delay are stated in para-3 of the application which we find sufficient for condoning the delay.

We therefore condone the delay by allowing the application, in term of the prayers made therein, subject to payment of costs of Rs. 5,000/- to wife within a period of four weeks from today. The application is disposed of.
