This is an application filed by the applicant seeking to condone the delay of 678 days in filing the appeal against the judgment and order dated 05.07.2018 passed by the learned Civil Judge Senior Division, Mehkar, District - Buldana, in LAC No.79/2010 where the reference Court has partly allowed the reference for enhancement.

The learned counsel for the applicant has drawn attention of this Court to paragraph 4 of the application in support of his request for condonation of delay.

Mr. Kadu, learned AGP appearing for respondents submits that he has no objection, if the delay is condoned subject to waiving interest on the delayed period.

Having heard the learned counsel for the parties and having perused the application, this Court is satisfied that the delay of 678 days in filing the appeal deserves to be condoned. Delay of 678 days is condoned subject to waiving of interest on the delayed period.

The civil application stands disposed of and list the appeal on 03.10.2022.
