By this petition, the petitioners seeks a direction to the respondent no.3-Collector, State Excise, Nagpur to implement the order passed by the Commissioner/respondent no.2 in Appeal, on 25.3.2015 and take immediate steps to permit the petitioner to run her business, by issuing a license in Form FL.III.

On the previous date of hearing, it was informed by the learned Government Pleader that the order passed by the Commissioner was subjected to revision. It is, however, informed by the learned government Pleader, on securing instructions today, that there is no stay in the Revision filed against the order of the Commissioner. It is stated that it is informed by the Government to the Collector, Nagpur by the communication dated 9th September 2015, a copy of

wp.2766.15 which is placed on record by the learned Govt.Pleader that it would be necessary to implement the order of the Commissioner. It is stated that the order of the Commissioner would be implemented as early as possible. It is stated that the licence in Form FL.III would be issued in the name of the petitioner within a period of ten days. The petitioner would be permitted to operate the licence on the petitioner furnishing an undertaking that she will surrender her licence in the event any law and order situation arises, in future. By accepting the statement made by the learned Government Pleader, which would be binding on the Collector, Nagpur, we dispose of the Writ Petition with no order as to costs.
