Heard learned counsel for the parties.

It is not in dispute that investigation for the offence under the Prevention of Corruption Act, in the matter of demand of bribe from the truck drivers etc. is in progress. Mr. Bansod, learned counsel for the applicant, submits that name of the applicant does not appear anywhere in the video recording. However, we do not agree. It is the matter of investigation and at present, it would be difficult to prejudge whether the applicant would be named or not during investigation.

That being so, for the present, we are not prepared to interfere in the matter. Hence, we make the following order.

ORDER

(i) Criminal Application (APL) No.307/2015 is rejected. Investigation to proceed further. (ii) The applicant is at liberty to apply for discharge, in case, charge-sheet is not filed against the applicant.
