Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.
2] Heard 3] The applicant is seeking regular bail in Crime 415/2020 registered with the Koradi Police Station, District Nagpur for offences punishable under section 364-A, 387, 342, 294, 506-B, 323 and 34 of the Indian Penal Code. 4] The case of the prosecution is that the complainant received a telephonic call from the applicant - accused asking the complainant to come at Gulam Grocery Shop within two minutes. A threat was issued that the
complainant would be killed if he does not comply. The complainant went to the grocery shop. The applicant - accused was present and he told the complainant that he has assaulted one Sandip Ghurile short while ago. The applicant - accused further asked the complainant why he visits Sandip's house and insisted that the complainant call Sandip. The complainant did call Sandip who disconnected the call. The applicant then assaulted the complainant and threatened him at gun point to summon Sandip telephonically. The applicant forcibly made the complainant accompany him in a Car and pressurized him to call Sandip. The applicant accused the complainant of being a police informer and demanded Rs.4,50,000/- threatening to kill the complainant.
The prosecution case is that in the interregnum Sandip approached the Koradi Police Station and one Police Officer called the complainant and the applicant - accused and summoned them to the Police Station. It was at this point in time that the applicant handed over his gun to his associate Ishwar and telephonically asked some other associate to kill Sandip after he returned from the police station.
5] The investigation is ongoing. The applicant is a history-sheeter and as many as sixteen offences are registered within the Nagpur City and on the admission of the applicant - accused eight offences are registered at Police Station Ghugus, District Chandrapur.
6] No case is made out for exercising discretion in favour of the applicant.
7] The application is dismissed.
