Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

It is seen from the case-diary that the prosecutrix, at the time when first incident occurred, was aged about 22 years and after occurrence of that incident of alleged rape, the prosecutrix went home and did not make any complaint. Thereafter, the prosecutrix used to meet the applicant from time to time. In these facts and circumstances, some doubt is raised about the constitution of the offence registered against this applicant. I am, therefore, inclined to grant this application.

The application is allowed. The interim anticipatory bail granted to the applicant by the order passed

2/4 by this Court on 27/04/2016 is hereby confirmed on the same conditions in addition to the condition that the applicant shall attend the concerned police station as and when required.

The application is disposed of in the aforesaid terms.
