Apprehending the arrest at the hands of police in connection with Crime No.18/2025 registered with Gramin Police Station, District Washim for the offence punishable under Sections 471, 467, 465, 451, 448, 420, 379 read with Section 34 of the Indian Penal Code, 1860, the applicant approached this Court for grant of pre-arrest bail.

Learned Counsel for the applicant submitted that crime was registered on the basis of a report lodged by Sanjay Bhimrao Godse on an allegation that the present applicant and other co-accused had forged the documents and entered their names on 8A extracts, and thereafter committed the theft of their household articles. On the basis of the said report, police have registered the crime against the present applicant and other co-accused. 3.

He submitted that, the allegations are levelled which are false and baseless due to the dispute between

the informant and the present applicant. The custodial interrogation of the present applicant is not required as nothing is to be recovered from him. In view of that, the applicant be released on anticipatory bail.

Learned APP strongly opposed the said application and submitted that the custodial interrogation of the present applicant is required considering the allegation of theft against the present applicant. Hence, the application deserves to be rejected.

I have heard learned Counsel for both the sides. On perusal of the investigation papers it reveals that out of the previous disputes the FIR came to be lodged against the present applicant. As far as the allegations are levelled which is to the extent the documents are forged. The documents are already collected during the investigation. The applicant is cooperated with the investigating agency. In view of that, the application deserves to be allowed. Accordingly, I proceed to pass following order:

(i) The application is allowed.

(ii) In the event of arrest, the applicant - Rambhau @ Ramaji Bhagwan Kolhe in connection with Crime No.18/2025 registered with Gramin Police Station, District Washim

for the offence punishable under Sections 471, 467, 465, 451, 448, 420, 379 read with Section 34 of the Indian Penal Code, 1860, be released on anticipatory bail, on executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

(iii) The applicant shall attend the concerned police station once in a week i.e.

on every Monday between 10.00 AM and 1.00 PM and shall cooperate with the investigating agency.

(iv) The applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic media.

The application stands disposed of.
