The learned Advocates for the respective parties submit that in connected First Appeal No.709/2013 this Court has permitted the claimant in that appeal to withdraw 75% of the amount deposited by the appellant.

Considering the order passed by this Court in First Appeal No.709/2013 and the facts of the present case, the respondent Nos.1 to 4 are permitted to withdraw Rs.3,00,000/-. The respondent Nos.1 to 4 will be entitled for

2 caf1598.16 withdrawal of Rs.75,000/- each. The balance amount be kept in fixed deposit in nationalized bank till the disposal of the appeal. The civil application is allowed in the above terms. JUDGE Tambaskar.
