JULY 12, 2017 Non application of mind on the part of the office of the Public Prosecutor is evident in the present matter. In spite of the fact that there was an acquittal, instead of challenging the said judgment, the interlocutory order is challenged by filing the present proceeding. The present application is therefore dismissed.
Victim is society and for the fault of the office of the Public Prosecutor, justice should not be denied to the society. Hence, liberty is granted to the applicant to take appropriate steps to question the correctness and legality of the judgment of acquittal of the non applicant. JUDGE kahale
