The applicant is arrested on 13-04-2015 in crime registered against three persons (including the applicant) for the offences punishable under Sections 3,4,5,7 of the Immoral Traffic (Prevention) Act, 1956 and Section 370 read with Section 34 of the Indian Penal Code. 3.

The crime is registered against the applicant on the statements of four girls who, according to the prosecution, are abused for carrying on prostitution. It is alleged that the applicant is searching and bringing the persons/customers to the place where the prostitution is being carried out.

The application is opposed on the ground that Crime No.3535/2014 is registered against the applicant on similar accusations.

Considering the nature of accusations against the applicant and as the non-applicant has not been able to show that custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail, however, on conditions as incorporated in the order.

The applicant having been arrested in Crime No.71/2016 registered by the non-applicant, he be released on bail, on furnishing P.R. Bond for Rs.25,000/- and two solvent sureties in the like amount.

The applicant shall attend the Police Station Ambazari, Nagpur on every Monday between 11-00 a.m. to 4-00 p.m. till the charge-sheet is filed.
