DATE : 02.07.2015 Heard the learned Counsel for the rival parties. The learned Counsel for the applicant invited my attention to the order dated 3.2.2015 in Criminal Application No.649/2014 passed by this Court and submitted that the case of the present applicant is at par with the case in respect of the said person who was granted anticipatory bail by this Court. I have perused the statement of Milind so also the FIR. Insofar as the statement of Milind is concerned, he has directly named the applicant as a person having wooden stick in his hand and made assault. The said order is clearly distinguishable inasmuch as the present applicant had actually assaulted him. The applicant is, therefore, not entitled for anticipatory bail. Hence, the following order.

ORDER

Criminal Application No.223/2015 is rejected. The applicant is at liberty to apply for regular bail. JUDGE Wadkar
