DATE : 10.5.2016 Heard Shri P.S. Khubalkar, advocate for the applicant and Shri J.Y. Ghurde, A.P.P. for the non-applicant.

The applicant is arrested on 2nd February, 2016 in crime registered against him, his father, his mother, his sister and husband of his sister for the offences punishable under Sections 306 and 498-A of the Indian Penal Code. The learned advocate for the applicant has submitted that the co-accused are granted bail by the Sessions Court. It is submitted that the charge-sheet is filed on 28th March, 2016.

Considering the nature of accusations against the applicant, the facts on the record and as the non-applicant has not been able to show that the custody of applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

Hence, the following order:

2 ba349.16 (i) The applicant having been arrested in Crime No.34/2016 registered by the non-applicant, he be released on bail on furnishing P.R. bond for Rs.25,000/- and two solvent sureties in the like amount.

(ii) The applicant shall attend the sessions trial regularly, unless granted exemption by the Sessions Court. (iii) The application is allowed in the above terms. CRIMINAL APPLICATION (APPP) NO.560/2016.

In view of disposal of main application, this application does not survive and is disposed accordingly. JUDGE Tambaskar.
