In all these appeals, a challenge has been raised to the judgment of the Reference Court partly enhancing the amount of compensation in favour of the claimants in the proceedings under Section 18 of the Land Acquisition Act, 1894.
3/3 Shri H.R. Dhumale, learned Assistant Government Pleader for the appellants in all the appeals, on instructions, states that the Sub-Divisional Officer, Gondpipri has issued communication dated 21/03/2016 in which it has been stated that all the appeals pertaining to Dindora Barrage, Tahsil Warora, District Chandrapur are to be withdrawn. The communication dated 21/03/2016 is taken on record and marked as 'Document- X' for identification.
Similarly, a pursis has also been filed on behalf of the Executive Engineer making similar request. In view of aforesaid, all the appeals are permitted to be withdrawn. The appeals are disposed of as withdrawn. The appellants would be entitled to receive the court fees in accordance with the rules. The respective claimants would be entitled to receive the amount of compensation as deposited with accrued interest in terms of the judgment of the Reference Court.
Order accordingly. No costs.
