Learned counsel for the respondents has tendered and affidavit sworn by the Assistant Registrar of University, which has been tendered on behalf of the respondents. The affidavit is taken on record and marked "X" for identification. Perusal of the affidavit in particular paragraph 3 thereof discloses that now the University has taken a decision not to initiate Departmental Inquiry against the petitioner. However, on perusal of the decision taken in this regard by the learned Vice Chancellor, it is seen that pendency of the petition is not the only reason; there are other reasons as well. They are enumerated on page no.2 of the decision of the learned Vice Chancellor. The net result of the above discussion is that the petition is rendered infructuous due to these subsequent developments. Learned

0605wp2974.04 2/2 counsel for the petitioner too has no objection that the petition be disposed of as infructuous owing to the above developments.

In the circumstances, writ petition is disposed of as infructuous. No order as to cost.
