(2) The applicant is apprehending arrest in Crime 391/2020 registered with Anjangaon Surji Police Station, District Amravati for the offence punishable under Section 307 of the IPC.

(3) The crime is registered on the basis of report dated 11.08.2020 lodged by the estranged wife of the applicant. The gist of the report is that applicant attempted to murder the complainant by pouring kerosine on her person. According to the complainant, she pushed her husband out of the house and locked the front door. The incident occurred at 11 O'

clock on 10.08.2020.

(4) The report is however lodged in the evening of next day. The explanation given in the report for the delay

9 aba329.20.odt is that the complainant contacted her father in the morning and her father who resides near Jalna come down to Anjangaon Surji and it was only thereafter that she lodged a report. The CDR produced prima facie substantiates the version that the complainant called her father telephonically. (5) Perusal of the case diary reveals that both the minor children, aged 11 and 41⁄2 years have corroborated the version of the complainant. At this stage, there is sufficient material in the charge-sheet to connect the applicant with the crime.

(6) No case is made out for the exercise of discretion, the application is dismissed.
